[_] None paying people

howdy all,

I built an online shop a while back for a person whom I've done some
work in the past, a friend now really, though the relationship started
out as a business one. For this project I've only been paid my 50%
deposit, and the site has been live now for a few months, and taken
over 1000 orders (over 30k). I'm positive my 'friend' has been paid by
his client, but this has not been passed to me, and I'm now evaluating
my options, as repeated emails and phone calls have not helped resolve
this.

I don't really want to take him to court, as he's a small business (a
single person like myself), but I'm not sure I have much other
options.

As far as I'm concerned, the code is still mine as our agreed price
has not been paid, so can maybe force the site offline until payment
is made (therefore putting pressure on from his client, making life
much harder for him).

I have a proposal which stipulates what I agreed to do, and this was
followed, but I don't have a contract or agreement of costs, other
than via emails. I did list the total amount on both invoices, does
that constitute a agreement to costs?

Any advice greatly appreciated!
